Please read these terms carefully before using DisasterStory.

Welcome to DisasterStory. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using DisasterStory, you agree to be bound by these Terms. If you disagree with any part of these terms, please do not use our service.

DisasterStory is operated by Futurespec Consulting, LLC d/b/a DisasterStory. These Terms are intended to protect DisasterStory, Futurespec Consulting, LLC, its owners, officers, employees, contractors, vendors, affiliates, successors, and assigns to the maximum extent permitted by law.

Acceptance of Terms

By creating an account, submitting a story, clicking to accept these Terms, submitting content, purchasing any service, or otherwise accessing DisasterStory, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, your only remedy is to stop using DisasterStory.

User Accounts

To use certain features of DisasterStory, you may need to create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any information that becomes outdated
  • Accept responsibility for all activities under your account

User Content

DisasterStory allows you to submit, share, and publish stories, comments, and other content ("User Content"). You retain ownership of your User Content, but by submitting it to DisasterStory, you grant Futurespec Consulting, LLC d/b/a DisasterStory a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, display, publish, distribute, excerpt, adapt for formatting, moderate, remove, and otherwise use your User Content in connection with operating, improving, protecting, promoting, and providing the service.

You represent and warrant that: (1) you own the User Content or have the right to use it; (2) your User Content does not violate the rights of any third party; and (3) your User Content complies with our Community Guidelines. You are solely responsible for your User Content and for any consequences that result from submitting or publishing it.

We may review, edit for formatting, refuse, hide, remove, restrict, or preserve User Content at our sole discretion, including for safety, moderation, legal, operational, or community reasons. We do not guarantee that any User Content will be published, remain published, or be recoverable.

Prohibited Conduct

You agree not to use DisasterStory to:

  • Submit content that is unlawful, harmful, threatening, abusive, or harassing
  • Impersonate any person or entity or falsely represent your affiliation
  • Publish false, misleading, or defamatory content
  • Share personal information of others without consent
  • Engage in commercial solicitation or spam
  • Promote self-harm, suicide, or illegal activities
  • Upload malware, exploit code, automated scraping tools, spam, or content intended to disrupt or reverse engineer DisasterStory
  • Use DisasterStory to provide emergency, medical, legal, financial, or professional advice to others
  • Attempt to bypass moderation, rate limits, access controls, payment controls, or security measures

Disclaimers & Limitation of Liability

Disclaimer of Warranties: DisasterStory is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, secure, error-free, accurate, complete, available, moderated within any timeframe, or suitable for your circumstances.

Not Medical Advice: The content on DisasterStory, including stories, comments, and linked resources, is for informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified mental health providers with any questions you may have regarding mental health conditions.

Limitation of Liability: To the maximum extent permitted by law, Futurespec Consulting, LLC d/b/a DisasterStory and its owners, officers, employees, contractors, vendors, affiliates, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages, lost profits, lost data, emotional distress, personal injury, reputational harm, business interruption, or losses arising from or related to your access to, use of, inability to use, reliance on, or submission of content to the service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to DisasterStory or these Terms shall not exceed the greater of: (a) the amount you paid to DisasterStory in the three months before the event giving rise to the claim; or (b) one hundred U.S. dollars ($100).

Indemnification

You agree to defend, indemnify, and hold harmless Futurespec Consulting, LLC d/b/a DisasterStory, its owners, officers, employees, contractors, vendors, affiliates, successors, and assigns from and against any claims, demands, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: your use of DisasterStory; your User Content; your violation of these Terms; your violation of law; your violation of another person's rights; or your misuse of any information, resources, or services made available through DisasterStory.

Third-Party Links & Resources

DisasterStory may contain links to third-party websites, services, or resources that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge and agree that Futurespec Consulting, LLC d/b/a DisasterStory shall not be responsible or liable for any damage or loss caused by your use of any third-party content or services.

Payments, Subscriptions, and Refunds

Paid features, subscriptions, donations, supporter plans, or other transactions may be processed by third-party payment providers. You agree to provide accurate payment information and authorize all applicable charges, taxes, renewals, and fees disclosed at checkout.

Unless otherwise required by law or expressly stated in writing, payments are non-refundable. We may change prices, features, or availability at any time, subject to applicable law and any specific written terms presented at purchase.

Termination

We may terminate or suspend your account and access to DisasterStory at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, our community, or third parties. Upon termination, your right to use the service will immediately cease.

Governing Law, Venue, and Dispute Resolution

These Terms, your use of DisasterStory, and any dispute, claim, controversy, or cause of action arising out of or relating to DisasterStory or these Terms shall be governed by, construed under, and enforced in accordance with the laws of the State of Mississippi, without regard to conflict-of-law principles.

To the maximum extent permitted by law, the exclusive venue and jurisdiction for all lawsuits, claims, disputes, proceedings, or causes of action arising out of or relating to DisasterStory, Futurespec Consulting, LLC d/b/a DisasterStory, or these Terms shall be a court of competent jurisdiction in Harrison County, Mississippi. You consent to personal jurisdiction and venue in that court and waive any objection based on inconvenient forum, improper venue, or lack of personal jurisdiction.

Before filing any lawsuit, you agree to provide written notice of the dispute to DisasterStory and allow at least thirty (30) days for informal resolution, unless emergency injunctive relief is legally required.

Class Action and Jury Trial Waiver

To the maximum extent permitted by law, you and Futurespec Consulting, LLC d/b/a DisasterStory agree that disputes must be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private attorney general action.

To the maximum extent permitted by law, you and Futurespec Consulting, LLC d/b/a DisasterStory knowingly waive any right to a jury trial in any dispute arising out of or relating to DisasterStory or these Terms.

Miscellaneous

If any part of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, asset sale, restructuring, or by operation of law.

These Terms, together with our Privacy Policy and any additional written terms presented for specific features, form the entire agreement between you and Futurespec Consulting, LLC d/b/a DisasterStory regarding the service.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of DisasterStory after such changes constitutes your acceptance of the new Terms.
